3 Important Planning Steps Before Working With A Divorce Lawyer

Tuesday, August 31st, 2010

If you are planning on a divorce then it is paramount to know how to work with a divorce lawyer. There are three important planning steps that you can use to make the process simpler and also try and keep costs down.

Get Organized - It is important that you get yourself organized. A lawyer is going to ask you for an inventory of all of your assets and liabilities. You can get all this information before you meet with the attorney. The attorney will need this information in the form of written evidence such as bank statements, credit card statements, etc. They cannot just operate on the work of their client in this matter. Understand that tax returns will likely be requested, also. Other items that come into play are 401K plan statements, pension statements, and IRA statements. Also, if you have wills or other documents that may prove that some of your property is separate and not community property. Separate property was either brought into the marriage or received in the form of inheritance.

Set priorities - Setting priorities can be vital in making sure that you do not get bogged down in the process. By priorities, I mean determining what is important for you. Remember that all the assets are going to be divided. You should figure out if you want to keep the house or not. You should then determine other material possessions and what is important for you.

It is important not to get too carried away, because you may not be able to “keep everything”. Realize that your spouse will get things as well. If you have children, determine who will get custody. Then determine a proposed visitation schedule for the other spouse. Children and visitation are often the issues that bog down the divorce procedure.

Be reasonable - Being reasonable can help you get divorced so that you can get on with your life. Think about what may be important to the other spouse. Sure you may hate him/her, but you still have to reach an agreement on separation of property, residence for the children, and visitation.

A big part of getting through the divorce procedure is being prepared for negotiations. This way ahead of time you can have an idea of what you may give up and what your spouse may give up. As mentioned under the priorities section, these are the things that really matter. Don’t treat this like a contest. Generally, the people that win in a contest are the attorneys due to the high legal fees that can be incurred. Realize that it may be a 50/50 split in the end. Thus, being reasonable should help you contribute towards the other spouse’s 50 while getting you the things that are most important.

In summary, a divorce lawyer works for an hourly wage in most circumstances. Planning on your part can help keep these costs down and also speed up the divorce process.

The Divorce Process From Start To End

Saturday, August 28th, 2010

The divorce process starts with the completion of a form known as the ‘petition for divorce.’ The form is also known as the D8 form. The three parts must be completed by the court, yourself and your ex partner. To file for divorce you must be married for at least one year.

You are able to get a divorce petition from your solicitor or the HM Court Service website. When you have completed the forms you should return them to your local family court.

The court will agree to a divorce if the marriage is deemed to be ‘irretrievably broke down.’ If you have been separated for two years or both agree to divorce a divorce will be granted. If only one partner wishes to divorce a divorce will be granted when you have been separated for five years.

When the form is submitted then you will have officially began divorce proceedings. The person who filed the forms is known as the petitioner and the other party is known as the respondent. When you have filed the forms you will need to then make copies of your marriage certificate and details of all your children (if you have children).

The court will then make a copy and send it to your ex partner and any co respondents you have chosen to name in the petition. Your estranged partner will have eight days to accept acknowledgement. If they do not do this a court bailiff will visit them and serve the papers.

The Decree Nisi is the next part of the process. This will be granted when the judge has been able to review all of the paperwork and is happy that there are good grounds for divorce.

The final stage of divorce is known as the ‘Decree Absolute’ and this can be applied for exactly six weeks and one day after the Decree Nisi is obtained. When you receive the Decree Absolute you are no longer classed as married and free to remarry.

New Study: Is Divorce Contagious?

Wednesday, August 4th, 2010

Many discussions have been held recently discussing the theory that getting divorced is actually contagious. Divorces happening later in life seem to be echoing the trend the most.

Statistics show that couples aged over 55 are now getting divorced more frequently- even though national divorce rates are starting to decrease. Around one fifth of divorces happen to people who have been married for twenty years or over.

According to the latest figures the main reason why women file for divorce is simply due to no longer feeling satisfied within the relationship whereas men tend to be filing for divorce mainly due to better prospects being made open to them. Around two thirds of all divorces in later life are filed for by women.

Three quarters of people who have divorced later in life rated their happiness as having improved significantly. With people statistically living for longer the idea of settling for second best is becoming something people are less likely to do. People now want much more out of their relationships than previously.

It is common to sometimes feel like everybody around you is divorcing at one time but a new study shows that there may be some scientific explanation behind this. Scientist have concluded that they have linked one divorce in a family to opening the doors to more divorces.

Friends are the most common group to fall into the contagious divorce trap. When a close friend divorces she or he may well talk of the benefits of doing so prompting so called ‘grass is greener’ ideas. Co-workers have been named as the second most common group.

The main relationship advice given to older couples is to keep communication levels high. Lots of later in life separations and divorces occur when two people begin leading separate lives. It is a good idea to try new thing’s together and visit different countries for holidays in order to avoid falling into the ’separate lives’ pitfall.

The True Cost Of An Affair

The True Cost Of An Affair

In recent times it seems hardly a week goes by without another celebrity divorce scandal being splashed on the front of the newspapers. The divorces seem to usually stem from one partner having an affair and reading details of the settlement is often the most intriguing part of the articles written about them.

One key example of somebody recently thrust under the spotlight due to an affair and now literally paying the consequences is Tiger Woods.

With leaked details of the divorce settlement suggesting that Woods’ wife Elin will receive a fortune of $100 million dollars the true cost of having an extra marital affair is highlighted.

Originally it was thought that the settlement would be worth around three quarters of a billion dollars but this has since been slated as being wide of the mark. Woods is worth 600 million dollars and bearing in mind often settlements entail splitting everything down the middle he looks to have gotten off lightly.

Woods and his wife have homes in both Florida and California but they are said to be following Florida state law as there is no state income tax in Florida.

Experts have suggested that if Woods and Nordgren had filed for divorce under Californian law Nordgren would have been likely to receive more of an entitlement due to California being community property state.

Children also need to be considered when divorce settlements are being arranged. It is thought that Woods’ wife will be given sole custody of the children and that he will have visitation and access rights. He is not expected to challenge this.

The cost of the mistake he made by having an extra marital affair is certainly high. Divorce settlements often take many, many months to complete and can be very complicated- even more so if children are involved.

The Legalities Of Dealing With Marriage Breakups

Sunday, April 11th, 2010

Divorce lawyers are only ever called when the marriage has broken down completely with little chance of reconciliation. In these circumstances you will need a divorce attorney who has at least half their workload in this area and one that is able to act as a mediator. All this will be waste if you do not feel you can trust them, so look for a person you feel comfortable with.

Adversarial attorneys will use the hammer to crack a walnut approach which often happens when these cases go to court whereas an attorney who specializes in mediation will take a much calmer approach. To save time when you contact your divorce lawyer, keep conversations brief and to the point, which can be achieved by preparing what you need from them in advance.

This is best done by knowing exactly what you intend to speak to them about and write down questions and answers in addition to when, and the length of the conversation on each occasion. Keep a file for all your notes, letters and documents so do as much as possible on the phone and by mail to keep the office time at a minimum.

Remember you divorce attorney is there for their expertise in the field and not to act as a counsellor, you should hopefully be able to use people close to you for that. Try always to stick to pertinent facts when speaking to your divorce lawyer, not general complaints about your spouse’s behaviour as this is just a waste of your money if use them as a sounding board.

Let your lawyer know from the start that you will be in charge of the case and they are there for legal advice and not as someone to lean on when things start getting rough. Tell them you want good advice and will rely on their experience, but that you expect to make decisions that concern the tone and strategy of the case. You must also let them know that you expect copies of all correspondence to be sent to you for your own records and if you contact them by phone, you expect a reply within one working day.

There are instances when you may not actually need direct legal representation but may just wish to use the services of a lawyer for advice on legal aspects like a marital settlement. In these circumstances you may only need to write down any issues you are unsure about and speak to your lawyer regarding those, and possible outcomes. Many couples now arrange marital settlements, and use a divorce lawyer to help them with this rather than resorting to the courts.

Are You Going Through A Difficult Divorce?

Sunday, March 28th, 2010

Whether you have received notification of your spouse’s desire for a divorce via her attorney, you should seriously consider arranging a divorce lawyer of your own. A divorce lawyer may have many functions but at the top of the list is the need for someone impartial to represent you and make sure you get a fair settlement. Your divorce lawyer is also there to be your level headed guide as many divorces can end acrimoniously and he will be there to ensure all your questions and worries about the proceedings are answered.

Despite feelings which may be to the opposite, always expect the divorce situation to get unfriendly when it comes to dividing the property and other assets. Naturally you have the option to represent yourself in your own divorce case but this is not a good recommendation and is not in your best interests especially when there are assets or children involved in the divorce, you will definitely want a divorce attorney to represent you.

The divorce laws vary widely from state to state, so don’t always listen to a friend you have in another state as the advice you get may not apply in your state. When alimony is required then the services of a divorce attorney will definitely be required as you cannot really represent yourself in this matter.

To most people the word alimony brings fear into the proceedings as it is support for the spouse and different for child support that is arranged separately as it is an amount calculated on the earning ability and standard of living both partners have as part of their marriage. Alimony can be awarded for a specified period of time or an indefinite period and this decision is based on the particular circumstances of each spouse.

However, should either partner experience changes to their lives then this arrangement can be reviewed. It is worth remembering that if a spouse receiving alimony should decide to have it stopped at any time, they cannot at a later stage ask for it to be reinstated.

Just about everything in a divorce case is vulnerable and this includes pensions or any retirement investments made so a divorce lawyer can help to protect these as much as possible. Any person with pension or retirement savings will have these divided with their spouse.

Although the court system will attempt to be fair in the division of money and assets, especially with pension and retirement accounts, a good divorce attorney will fight for your rights and make sure as much as possible is done to your benefit. Your divorce attorneys fees will no doubt be high but what he can save in losses in just the matter of your pension will more than make up for this.

Advantages Of Getting Lawyers For Your Personal Injury Case

Friday, February 19th, 2010

Have you ever been injured in an accident? You may be really alert in your every step, but you cannot avoid each and every accident that may happen on you. There are times that even the most avoidable accidents still happen because of another people’s carelessness.

It’s true that nobody likes an accident to happen, that’s why they are unintended. But sometimes, it’s the fault of another person. It may be a case of a road fender bender caused by someone under the influence of alcohol or a harmful ingredient in a shampoo that the manufacturer missed to test first.

Of course we wouldn’t like to find fault in others just so we can have someone to blame for our accidents. But let’s be practical here. When a person has been wounded in an accident, there’s the issue of hospitalization cost and the loss of earnings you would have made working instead of convalescing in the hospital. And those are just few of the concerns one encounters after an accident, things that wouldn’t have occurred in the first place if nobody was negligent.

An attorney specializing in personal injury suits would help you get through the process. Overwhelming at first as it may seem, a personal injury counsel actually simplify matters for you.

The first thing lawyers would do is ascertain whether you were really a victim of personal injury cases. If they believe that you have a case, then they would file a claim against the defendants

You and your lawyers may probably need to collect proof to fortify your case. You may be required to gather health records and bills, testimonies from eyewitnesses, and expert advice, depending on the nature of your case.

The defendants would naturally gather their own proof, just to assert that they were never negligent and the mishap was plausibly your own fault. Your personal injury lawyers should be able to counter that. It is not uncommon that you and your attorneys would have to meet with the other camp first and try to agree on a settlement before a court hearing is scheduled.

However, if they can’t agree on a settlement, a judge will decide a non-negotiable amount to be awarded to the complainant. This phase is generally avoided because not only does the process take longer, the sum the judge will fix for the claimant may be substantially higher or lower than the complainant and defendant originally talked about.

Because of the time-consuming process of the whole thing, a person without the aid of a personal injury lawyer may want to quit pursuing the suit entirely. That’s why a counsel is necessary. They can be your champion in all this mess. With their help, you would be entering the legal arena with total confidence and knowledge of what’s to come.
